Terms of Service

Please read these Terms of Service carefully before using the ShiftMatch platform. By creating an account or using our services, you agree to be bound by these terms.
1. Introduction & Acceptance
These Terms of Service ("Terms") govern your use of the ShiftMatch platform ("Platform") operated by ShiftMatch Australia Pty Ltd ("ShiftMatch", "we", "us", or "our"), incorporated in New South Wales, Australia.
By accessing or using the Platform you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.
2. Definitions
- Platform: The ShiftMatch website, mobile application, and related services at shiftmatch.work.
- Worker: An individual who creates an account to find and perform short-term shifts.
- Employer: A business or individual who creates an account to post and fill short-term shifts.
- Shift: A short-term work engagement posted by an Employer and accepted by a Worker through the Platform.
- Commission: The 15% platform fee charged by ShiftMatch on the total value of each completed Shift.
- Completed Shift: A Shift confirmed as completed by both parties, or confirmed by ShiftMatch following dispute resolution.
3. Eligibility
- Be at least 18 years of age;
- Have the legal right to work in Australia (for Workers), including a valid visa with work rights where applicable;
- Hold a valid Australian Business Number (ABN) if registering as an Employer;
- Provide accurate, truthful, and complete registration information;
- Not have been previously suspended or banned from the Platform.
4. Account Registration & Verification
Employers must provide a valid ABN during registration. ShiftMatch verifies ABNs against the Australian Business Register. Employers with an unverified or cancelled ABN cannot post shifts.
Workers must complete identity verification powered by Didit.me. This may require a government-issued photo ID. Identity data is not shared with Employers.
You are responsible for the confidentiality of your account credentials. Notify us at legal@shiftmatch.work if you suspect unauthorised access.
5. Worker Obligations
- Maintain valid work rights in Australia for the duration of each Shift;
- Provide accurate information about your skills, experience, certifications, and availability;
- Hold and maintain all required certifications for shifts you accept (e.g., RSA, White Card, Food Handler Certificate);
- Attend each confirmed Shift punctually and complete it as agreed;
- Notify the Employer and ShiftMatch as soon as possible if you cannot attend a confirmed Shift;
- Comply with all reasonable workplace policies and WHS requirements of each Employer;
- Not accept payment outside the Platform for work arranged through ShiftMatch.
No-Show Policy: Three (3) confirmed no-shows within any 12-month period will result in automatic account suspension. ShiftMatch reserves the right to immediately suspend accounts with excessive cancellations at its discretion.
6. Employer Obligations
- Maintain a valid, active ABN throughout your use of the Platform;
- Provide accurate, complete shift descriptions including duties, location, hours, pay rate, and required certifications;
- Pay Workers the agreed rate for all completed shifts;
- Comply with the Work Health and Safety Act 2011 (Cth) and provide a safe workplace;
- Comply with the Fair Work Act 2009 (Cth) and the National Employment Standards;
- Not arrange future work with Workers outside the Platform where that work was facilitated through ShiftMatch.
7. Payments & Commission
ShiftMatch charges a 15% commission on the total value of each completed Shift, automatically deducted before disbursement to the Worker.
Workers receive payment via bank transfer within 24 hours of shift completion confirmation.
All amounts are in Australian dollars (AUD). GST applies to the platform commission under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
8. Identity & Verification
Worker identity verification is powered by Didit.me. Verification data is encrypted, not shared with Employers, and retained per our Privacy Policy. Workers who decline verification may be restricted from certain features.
9. Certifications
Certain shifts require certifications including RSA, White Card, Food Handler Certificate, WWCC, and First Aid. It is the Worker's sole responsibility to maintain valid, current certifications. Providing false certification information may constitute fraud.
10. Prohibited Conduct
- Arranging or accepting payment outside the Platform;
- Providing false, misleading, or incomplete information;
- Harassing, threatening, abusing, or discriminating against other users;
- Accessing accounts or data you are not authorised to access;
- Using the Platform for any unlawful purpose;
- Scraping or reproducing Platform content without permission.
11. Dispute Resolution
- Step 1 — In-App Dispute: Raise within 48 hours of shift completion. ShiftMatch will determine within 5 business days.
- Step 2 — Mediation: If unsatisfied, parties attempt mediation before legal proceedings.
- Step 3 — Courts: Disputes subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
12. Termination & Suspension
- No-Shows: 3 confirmed no-shows within 12 months → automatic suspension;
- Policy Violations: Breach of these Terms;
- Fraud: Immediate permanent ban and potential law enforcement referral;
- Inactivity: 24 months inactive may result in deactivation with notice.

13. Limitation of Liability
To the maximum extent permitted by Australian law, ShiftMatch's liability is limited to the total commission paid by you in the 3 months preceding the event giving rise to the claim. We are not liable for indirect loss, loss of income, actions of Workers or Employers, or workplace injuries.
Nothing in these Terms limits rights that cannot be excluded under the Australian Consumer Law.
14. Privacy
Our Privacy Policy forms part of these Terms and governs our collection and use of your personal information.
15. Changes to Terms
We will notify you of material changes at least 14 days before they take effect. Continued use constitutes acceptance. Current version always at shiftmatch.work/terms.html.
